>> reporter: good morning, savannah. very sad and dire situation here. 19 people are now confirmed dead , and more are missing. i want to show you just how bad the devastation is. take a look at this boat. it was washed up on to a residential street from the ocean, and it's like this all along here with boats strewn out all over this road. masts tangled in power lines . it got so bad that a lot of boats reached people's front doorsteps. people in this community are frustrated and hungry, without power and supplies. it is just not a good scene here, and it's a scene playing out in communities all across this region affected by sandy. in sandy's cruel wake profound loss and increasing anger as the pain she's inflicted continues to grow.

>> something has to be done immediately.

>> reporter: across a swath of the ravaged northeast, families try to put the pieces back together, but it's not so easy, and here in staten island they are desperate.

>> we have bodies being removed up the block. we are devastated here.

>> reporter: on thursday the death toll on staten island alone rose to 19 when the bodies of two young boys , ages 2 and 4, were recovered after being ripped from their mother's arms in the storm surge . residents here still without power or supplies. their furry bubbling, saying it's the forgotten borough. fema has come to help.

>> we are the eyes and the ears for the state and federal coordinators.

>> reporter: but it's simply too little too late, the burough president insists.

>> people with big salaries out to be out there and i'm disappointed.

>> reporter: in hoboken, new jersey, the national guard is handing out critical supplies but there, too, thousands are without power, heat, food, cash or medicine. the line outside of cvs staggering, but lines are the new normal everywhere.

>> i was in this line for about an hour. people, they are cutting in line.

>> reporter: waiting for gas to char charge phones or just to get supplies.

>> they are waiting on buses.

>> reporter: it's a nightmare in new york city for some. despite limited subway and mass transit service up and running, it's a super slow go and thousands have to commute by foot.

>> walked across the brooklyn bridge .

>> in manhattan hundreds of thousands still in the dark, some cold and starving.

>> people are dumpster diving and what they are going after is the food.

>> reporter: it may be days before the power is back.

>> over 100,000 power lines on ground.

>> reporter: across new york's long island power is out and patience is running out.

>> i don't have the transportation out of here.

>> reporter: in toms river , new jersey, a high school is now a shelter. in westwarck, connecticut, belongings remain strewn about.

>> we need to get cleaned out.

>> reporter: in west virginia the weight from sandy's heavy snow on monday has now collapsed roofs. the storm's wrath widespread and strong.

>> no heat. we have no power.

>> reporter: still, officials are encouraging.

>> the good news is that there are a lot of people who want to help.

>> reporter: but the grim reality, not so easy to swaggo, sandy's sting far and wide and getting back to normal means a new normal.

>> in the cold and the dark.

>> reporter: the recovery for many an uphill battle.

>> you need to come here and help us. we need assistance, please.

>> reporter: and some good news. top fema officials are coming here to staten island today as well as the department of homeland security , including secretary janet napolitano . matt, i know they said it's too little too late but this is attention they definitely need and deserve right now.

Patrick Gudauskas and Dusty Payne cause couple of Round 1 - Bettor

Patrick Gudauskas and Dusty Payne cause couple of Round 1 upsets at O?Neill Coldwater Classic

America?s Patrick Gudauskas and Hawaii?s Dusty Payne were responsible for a couple of huge upsets featured in the opening round of the O?Neill Coldwater Classic, the ninth of ten stops on the 2012 Association of Surfing Professionals (ASP) World Championship Tour, which got underway at Santa Cruz in California, America, on Thursday, November 1, 2012.

Gudauskas got the better of Brazil?s Heitor Alves and more importantly Hawaii?s John John Florence in the third heat of Round 1, earning his place in the third round while relegating his two rivals to Round 2.

The fourth heat saw Payne claim victory over Australia?s Mick Fanning and Kieren Perrow, forcing both his rivals to take a trip of Round 2 while advancing straight to Round 3 himself.

The opening day of the latest elite tour event saw the point-break of Steamer Lane getting graced with shifting two-to-four foot waves, which seemed like an ideal stage for the battles between the best surfers from around the globe to take on.

Gudauskas, who had not been in the best of forms during the 2012 ASP World Championship Tour, found himself pitted against Alves and Florence, currently fourth on the ASP World Title rankings.

Despite having his work cut out for him, the American surfer made the most of his local knowledge of the waves to walk away with the win after earning a 5.83 and 7.33 off his best-two waves for a heat-total of 13.16 points.

Alves scored a 4.63 and 8.33 off his best-two waves to eventually register a heat-total of 12.96 points, which forced him to settle for second place.

Florence, who had been in a formidable form throughout the year, failed to get off to the sort of start that he was looking for and found himself getting relegated to Round 2 after scoring a 4.93 and 2.07 off his top-two business-waves for a heat-total of 7.00 points.

The fourth heat saw Payne earn credit for the second huge upset of the day by getting the better of former two-time ASP World Champion Fanning, while also defeating Perrow to secure his place in Round 3.

The Hawaiian surfer got off to an excellent start, earning a 6.83 off his first business-wave and backed it up with an 8.47-point ride, thus getting to what proved to be a decisive two-wave total of 15.30 points.

Fanning created a chance for himself to take the win after earning an 8.17 off his first business-wave halfway through the heat, but managed to back it up with an inadequate 6.77, thus having to settle for second place with a heat-total of 14.94 points instead.

Perrow finished third with a heat-total of 12.93 points, which comprised of a 5.93 and 7.00-point ride, consequently getting relegated to Round 2 as well.

Building fences for physical therapy- a boy's memory... - Public ...

As a fourth year medical student, I took an elective in Physical Medicine and Rehabilitation.? I also have a niece whose husband is a physical therapist, and a number of my friends are likewise.? I have also undergone three knee surgeries, so my exposure to the rehab field is fairly extensive.? But as in most instances, one?s attitudes towards most things are molded from early on and my perception of what constitutes proper rehabilitation dates from an incident from my early years.

I would preface this account with a disclaimer- though my father is a physician, most of what passed for medical care in our home growing up was surprisingly (or not) made up of a cursory exam to see if life or limb was endangered, and if not, we were sent on our way.? I will say that when one of us thirteen children had sustained significant trauma or a serious illness, Dad was there with a timely suture (albeit with the surgery performed on the kitchen table) or an I.V. pole set up in the living room (for my immediate younger brother, who, it must be stated, still gets woozy just looking at a merry-go-round) for a gastrointestinal bug?that got out of hand.?? I also must admit under duress from my lovely wife that my triage
interaction with my own kids has been of a similar variety; not a lot of time was spent nurturing a boo boo.? If they could walk and talk without too much blood loss, they were generally good to go.

We raised cattle on our farm, an enterprise that lent itself to many different projects (calling them chores would make these seem so?so mundane), not the least of these was building and fixing fence.? Poor fences led to the cows getting out, going down into the San Pedro River, and climbing out into someone else?s pasture which usually would generate a phone call to our house which in turn would lead to our tromping off to gather the cattle-which typically led to a lot of mumbling and cursing under our collective breaths.? Most of our venom was directed at the erstwhile free-range bovines, when it probably should have been targeted at ourselves, since we were the ones who had built the shoddy fences in the first place.? I?m sure our dad had no problem figuring out where to lay the blame.?

Cow and fence

Granted, we were relatively young when we first started building fence, and by the time I was in sixth grade and my older brother in eighth, he was in charge of quite a motley crew of fence builders that consisted of me and probably two or three other younger brothers.? The youngest of these brothers will claim that he was an integral part of the team, but as he was only six or seven at this stage in the enterprise, he likely was just assigned to place the clips along the fence posts that we used to tie up the barbed wire.? Either that or he spent the time drinking all our lemonade.? At any rate, fence building was quite the big deal; it kept us busy with its seemingly never-ending construction and it kept the cattle busy working at ways to countermand our efforts.

Fence fixing

And so it was that my older brother broke his ankle wrestling.?

Imagine the monkey wrench this threw into the gears of such a smooth fence-building operation.? Cattle would be roaming all over the San Pedro Valley with our brand affixed to their backsides and advertising for all to see whose farm had the lamest fence constructionists; we would surely be the laughingstock of all the farms along Airport Road.? We needed older brother to run this crew; pounding fence posts required some modicum of skill, but it mostly required someone with the brawn necessary to hoist a fifty pound post-pounder above his head and over the post and give it repeated whacks until the post is subdued and pounded into approximately two feet of the terra (really) firma of our dad?s farmstead.? As I said, I was only 12 or so and the prospect of pounding all those posts was not the first?item on my to-do list that winter.?

Sometimes events in our lives line up just the way we would have them and so it was in mine.? Given my father?s predilection for eschewing unnecessary convalescence or rehabilitation (or perhaps believing that his prescription was better than anything a physical therapist could offer), my brother ventured out after a few days of recuperation with his ankle to knee cast intact, awkwardly wielding his crutches from one post pounding to the next.? We younger siblings gratefully hauled the pounder for him from post to post and solemnly held the post for him to resume pounding every six paces or so.? We weren?t going to mess up a really good thing by suggesting to Dad that perhaps it might be better if brother were allowed to recover back in the house, leg propped up with a warm cup of hot chocolate in hand, undoubtedly surrounded by a number of fawning sisters.

Post pounding

And so that fence was finished. ?????

I suppose my brother?s ankle healed nicely.? I assume to this day that he has full range of motion in the ankle. ?I can?t detect any discernible limp.? I'd?like to think?that the cattle were chagrined at the fact that yet another expanse of fence was built in time to thwart any further exit strategies.? Though I?m sure they managed to find a way out a few weeks later anyway. ?????

Sworkit: A Mobile App for Working Out Anywhere | Greatist

Whether there?s no time to trek to the gym, group fitness classes aren?t your cup of tea, or you?re stuck indoors because of a massive hurricane (here?s looking at you, Sandy), there might be some natural obstacles (or natural disasters) standing in the way of a workout. A new app called Sworkit is aiming to give on-the-go fitness a fun new spin, and may be the answer to having an effective workout almost anywhere.

(Also Check It: 10 Interval Training Mobile Apps to Download Right Now)

Sworkit
How It Works

Sworkit is a randomized circuit-training app that allows people to choose what they want to work out, and for how long. Users decide whether they want to strength train or perform a yoga/stretching sequence, followed by choosing which part of the body to tackle (upper body, lower body, core, full body) or type of flexibility routine (sun salutations, back strength, full-body stretch). The last step is to pick the length of the workout (from five minutes up to an hour).

Each individual exercise lasts for 30 seconds and is accompanied by an in-app illustration. If a move is totally foreign (what?s a spider-man pushup?) there?s the option to pause the clock and watch a quick demonstration. For those who want to know what they?re getting into ahead of time, there?s also an online exercise library with descriptions of each move.

Hands-On with Sworkit

I decided to give the 30-minute full-body sequence a try in the safety of my Brooklyn apartment. I jumped right in, doing thirty seconds of push-ups followed by squats, hip raises, and windmills. To my (thankful) surprise, the app prescribes a thirty second rest period every few minutes, which gave me time to grab a sip of water and wipe the inevitable sweat off my forehead.

The randomization of each exercise kept things interesting, but also made certain aspects of the workout frustrating. On the one hand, I was happy anticipating each move (I wonder what?s next!) but wasn?t too keen on diamond pushups immediately followed by wide arm pushups. The exercises sometimes felt rushed, too. Each move goes straight into the next one, so the clock starts ticking even if you?re not ready for it. (I had to run over to my futon to do tricep-dips, which cost me 10 precious seconds.)

However, the pro-version of the app is definitely worth the $0.99 splurge. With?Sworkit Pro, there?s an audible announcement of each exercise (rather than just a visual cue) and you can track weekly and monthly goals. Perhaps most importantly, though, is the ability to choose how many seconds of occurs between each exercise.?When I gave Sworkit Pro a go, I did the same workout but set a four-second rest between each move, which made a world of a difference. I was also able to listen to the audio cues and barely looked at my phone throughout.

(Also Check It: 11 iPhone Apps to Strength Train and Lift Smarter)

The Verdict

There?s no denying that after my session with Sworkit, I was?tired. Yet the time flew by as I swiftly moved through single leg squats, side bridges, burpees, and (many) more moves. But perhaps the real beauty of Sworkit is every move only requires bodyweight, so users don?t need extra equipment. Users can theoretically get a workout anywhere.?

The number of options available makes this a tool nearly anyone can use, too. For those who want a 10-minute full-body stretch, a five-minute core-workout, or a 20-minute set of sun salutations, Sworkit can help make it happen.

Ready to try it??Download Sworkit or Sworkit Pro from the iTunes store. (Compatible with iOS and Android mobile devices.)

Have you tried Sworkit or Sworkit Pro? Let us know in the comments section below, or tweet the author?@lschwech.

A holographic will is legal in California. There are some stipulations but it is much cheaper. Pretty much just the cost of getting notarized.

We should all plan ahead. Creating a will is one essential step. Also one should create a durable power of attorney for health care. And a power of attorney for property management. If married, your spouse needs an equivalent set of documents. The internet will provide examples.

I am a local Financial Planner and have a lot of experience with estate planning. IF you have any assets, especially a home, you probably should consider a living trust instead of a will, for a variety of reasons. Either way, you should consider calling an estate planning attorney, describe your situation on the phone, see what they suggest and go from there. A local attorney, very professional and a very nice guy is Chris Jones, 1032 SB Street. We refer a lot of our clients to him. He is well respected and will treat you very fairly.

Thanks for the recommendation to Chris Jones, for whom I work. If you mention that you came to us through EdHat, we'll even give you a 10% discount. Anyone who owns real property in California should consider a trust in place of a Will, so that probate (through the court system -- time consuming and much more costly) may be avoided. If your estate is worth $150,000 or less and doesn't involve real property, then a Will may be a better choice, however. Chris can help you decide.

A "living will" is not a Will at all -- it is another estate planning tool, an advanced health care directive. This is also very important but does something quite different from disposing of your property.

Call us and we'll schedule an appointment (first consult is free) to give you more details. 805-963-2014.

The "financial planner" who recommends a trust instead of a will is misleading you. Ideally you would have both as they are not and either/or choice. There is a big cost difference. You can prepare your own will but the trust should involve an attorney. Also, the trust will be 30 to 40 pages long and require an attorney to understand it. Yes, I have a trust, but it is not the answer for everyone.

?

?EDHATBARBARA agree helpful negative off topic

2012-11-02 02:50 PM

It isn't necessary for a trust to be 30 to 40 pages long! Software will spit one out that long, but an attorney worth his or her salt can hone it down to considerably less than that, under most circumstances, if that's what your needs require. A "pour over Will" is useful with a trust, but not always necessary; which is why talking to a lawyer is important, regardless of whether you do your own documents eventually, or have an attorney prepare them for you.

Artificial Misting System Allows Reintroduction of Extinct Toad

Not by definition.

I disagree. We have a remarkable ability to adapt even over very short time periods. For example, nuclear subs would remain habitable for years. That would be enough time to reestablish a human presence on the surface of Earth. And one can always come up with biological, mechanical, or

Ainsworth Announces 2012 Third Quarter Results

1.11.12

NEWS RELEASE
October 31, 2012

AINSWORTH ANNOUNCES 2012 THIRD QUARTER RESULTS

Vancouver, British Columbia ? Ainsworth Lumber Co. Ltd. (TSX: ANS and ANS.WT) today announced its financial results for the third quarter ended September 30, 2012.

Third Quarter Highlights:
> Achieved positive adjusted EBITDA of $37.3 million ? $20.2 million higher than the prior quarter and $36.6 million higher than the third quarter of 2011.

> Liquidity position improved by $32.4 million during the third quarter.

> Subsequent to the quarter end, announced a comprehensive refinancing plan; this transaction will significantly improve our financial position.

Ainsworth Performance Improves In Third Quarter
Ainsworth President and Chief Operating Officer, Jim Lake said, ?I am pleased to report that Ainsworth recorded strong financial results in the third quarter of 2012. Adjusted EBITDA for the third quarter was $37.3 million, an increase of $20.2 million compared to the prior quarter and $36.6 million compared to the same quarter last year. These were our best quarterly adjusted EBITDA results since the first quarter of 2006. The improvement in EBITDA reflects a strong pricing environment during the quarter. From an operational standpoint, all three mills ran efficiently and generated an increase in production volumes.?

Financial Results
Sales were $115.6 million in the third quarter of 2012, an increase of $43.8 million from the third quarter of 2011 due to an improvement in market prices and an increase in shipment volumes. Adjusted EBITDA for the third quarter of 2012 was $37.3 million compared to adjusted EBITDA of $0.7 million in the same quarter last year. Ainsworth recorded net income from continuing operations of $32.6 million in the third quarter of 2012, compared to a net loss of $58.9 million in the third quarter of 2011. This change is primarily the result of a $61.2 million increase in foreign exchange gain on long-term debt, a $36.5 million increase in gross profit (sales less cost of products sold (exclusive of amortization)), and a $12.5 million increase in gain on derivative financial instrument. The increase was partially offset by a $15.4 million increase in income tax expense, a $1.9 million increase in foreign exchange loss from operations, and a $0.8 million increase in interest on long-term debt.

Year to date sales of $291.2 million for 2012 were $43.8 million higher than 2011 as a result of market price increases and higher shipment volumes. Adjusted EBITDA for the nine months ended September 30, 2012 was $64.4 million compared to adjusted EBITDA of $9.8 million in the same period last year. Net income from continuing operations increased from $5.9 million in the first nine months of 2011 to $22.0 million in the first nine months of 2012. The increase resulted from a $54.1 million increase in gross profit, a $45.7 million increase in foreign exchange gain on long-term debt, and an $11.9 million increase in gain on derivative financial instrument. The increase was partially offset by a one-time gain on the High Level acquisition of $72.5 million in 2011, a $17.8 million increase in income tax expense, a $2.8 million increase in interest on long-term debt, and a $1.9 million increase in foreign exchange loss from operations.

Margins
Adjusted EBITDA margin for the third quarter of 2012 was 32.3% compared to 1.0% in the first quarter of 2011. For the year to date, the 2012 adjusted EBITDA margin was 22.1% compared to 4.4% in the same period of 2011.

In the third quarter of 2012, the North Central price for the benchmark 7/16? OSB averaged U.S. $313 per msf, an increase of 70% relative to the third quarter of 2011. The increase compared to the second quarter of 2012 was 33%. The Western Canadian price for the benchmark 7/16? OSB averaged U.S. $310 per msf in the third quarter of 2012, an increase of 126% relative to the third quarter of 2011. The increase compared to the second quarter of 2012 was 34%.

Selected financial information is presented in the table below.?

?

(1) Adjusted EBITDA, a non-IFRS financial measure, is defined as net income (loss) from continuing operations before amortization, gain on disposal of property, plant and equipment, cost of curtailed operations, stock option expense, finance expense, foreign exchange (gain) loss on long-term debt, other foreign exchange loss (gain), income tax expense (recovery), and non-recurring items.
(2) Adjusted EBITDA margin, a non-IFRS financial measure, is defined as adjusted EBITDA divided by sales.
(3) 100,833,888 common shares were outstanding on September 30, 2012.

Liquidity
At September 30, 2012, Ainsworth?s available liquidity, consisting of cash and cash equivalents, and short-term investments, was $86.6 million, an improvement of $32.4 million during the third quarter, and $28.9 million since December 31, 2011 resulting from our strong operating results year to date.

Subsequent to the quarter end, Ainsworth announced its intention to proceed with a comprehensive refinancing plan involving a fully backstopped rights offering to raise gross proceeds of $175 million through the issue of common shares (the ?Rights Offering?), and a debt financing for gross proceeds of approximately $350 million (the ?Debt Financing?). The aggregate net proceeds received by Ainsworth from the Rights Offering and the Debt Financing will be used to repay in full Ainsworth?s outstanding Senior Secured Term Loan due June 2014, and 11% Senior Unsecured Notes due July 2015. This refinancing plan is expected to position us well across industry cycles through reduced debt, lower borrowing costs, and the extension of our maturity profile.

We continue to leverage on Ainsworth?s operational expertise, superior products and customer relationships to ensure the Company is also well positioned from an operational standpoint, to capitalize on a recovery in U.S. home construction and increased demand from Asia.

Outlook
The U.S. housing market during the quarter continued to show signs of improvement with significant increases in housing starts and building permits being registered year-over-year and sequentially. On a seasonally adjusted annual rate, housing starts during the quarter increased 28% relative to the same period last year and 7% relative to the second quarter of 2012. More importantly, housing permits, which are a measure of future demand, increased 33% relative to the same period last year and 11% relative to the second quarter of 2012. Industry forecasts of U.S. housing starts for 2012 and 2013 have recently been raised to 760,000 and 930,000 respectively. These levels are a marked improvement relative to the 610,000 starts recorded in 2011.

We believe a recovery in U.S. housing is now underway and should accelerate over the next 12 to 24 months. This will be positive for Ainsworth, notwithstanding certain idle capacity in the industry. We will be prudent in the start up of our High Level mill and will do so when we have identified a market for its production in both the North American and export markets. The High Level mill would represent a 50% increase in our current operating capacity and is a significant growth opportunity. It is one of the largest production facilities in the industry and will be an efficient producer, benefiting from an abundance of high quality, low cost fiber.

Management Change
During the quarter we welcomed Rick Eng to the senior management team as Vice President, Finance and Chief Financial Officer. He brings a depth of experience in corporate finance to the senior management team and will be a valuable contributor in his new role with our company.
