Judge OKs contentious part of Ariz immigration law | IndiaPost

PHOENIX: Arizona authorities can enforce the most contentious section of the state?s heavily debated immigration law, according to a federal judge?s ruling regarding a section of the statute that critics have dubbed the ?show me your papers? provision.
The ruling by US District Judge Susan Bolton clears the way for police to carry out the requirement that officers, while enforcing other laws, question the immigration status of those they suspect are in the country illegally.
Arizona Gov. Jan Brewer hailed the ruling on what she called ?the most critical section? of the state?s immigration law.
Critics have assailed the provision as un-American, saying it paves the way for ethnic discrimination and racial profiling, providing officers a justification for stopping people based on how they look.
Alessandra Soler, executive director of the American Civil Liberties Union in Arizona, said the section of the law is ?divisive? and will ?lead to rampant racial profiling and prolonged detention for countless Latinos, a majority of whom are US citizens and permanent residents.?
Proponents say that?s a misinterpretation of a law necessary to stop immigrants from illegally coming into the US and using up scant resources. They say there?s nothing wrong with being asked to provide identification proving legal status.
Brewer, a Republican, said the ruling ?will empower state and local law enforcement, as part of a legal stop or detention, to inquire about an individual?s immigration status when the officer has reasonable suspicion.?
The provision has been at the center of a two-year legal battle that resulted in a US Supreme Court decision in June upholding the requirement.
After the nation?s highest court weighed in, opponents asked Bolton to block the section of the law, arguing that it would cause systematic discrimination and unreasonably long detentions of Latinos if it?s enforced.
Brewer?s office, however, urged the judge to let the requirement go into effect, saying the law?s opponents were merely speculating in their racial profiling claims. The Republican governor?s office also said police have received training to avoid discriminatory practices and that officers must have reasonable suspicion that a person is in the country illegally to trigger the requirement.
In her ruling, Bolton said the court will not ignore the clear direction from the Supreme Court that the provision ?cannot be challenged further on its face before the law takes effect.? She reiterated the high court?s interpretation that the law might be able to be challenged as unconstitutional on other grounds.
The Obama administration?s case was based on the argument that federal immigration law trumped Arizona law. The challenge didn?t confront racial profiling.
The Obama administration declared a measure of victory after the Supreme Court decision, as the court said local police cannot detain anyone on an immigration violation unless federal immigration officials say so.
President Barack Obama said in the aftermath of the ruling that police should not enforce the provision in a way that undermines civil rights.
?No American should ever live under a cloud of suspicion just because of what they look like,? he said at the time.
Arizona?s law, known as SB1070, was passed in 2010 amid voter frustration with the state?s role as the busiest illegal entry point into the country. Five other states ? Alabama, Georgia, Indiana, South Carolina and Utah ? have adopted variations.
Shortly before the law was to take effect in July 2010, Bolton prevented police from enforcing the questioning requirement and other parts of the statute, ruling the Obama administration would likely succeed in its challenge.
Brewer, who signed the measure, appealed the ruling, lost at the 9th Circuit Court of Appeals and took her case to the Supreme Court.
Brewer?s office said the law is expected to go into effect shortly.
Less controversial sections of the law have been in effect since late July 2010, but have rarely been used.
Lydia Guzman, a civil rights activist in Phoenix and leader of the group Respect Respecto, which tracks instances of racial profiling, said that if a higher court doesn?t issue an emergency order stopping the provision from taking effect, her organization and others will be watching carefully.
If legal residents feel they are the victims of discriminatory treatment once the provision kicks in, Guzman said, ?we want them to contact us. Those are the cases we are going to be taking to court.?
The chief sponsor of SB1070, former state Senate President Russell Pearce, called Bolton?s ruling a ?huge win.?
?The problem isn?t the law,? he said. ?The problem is a broken political system and those that fail to keep their commitment to defend the law.?
Maricopa County Sheriff Joe Arpaio said the ruling doesn?t change what his office already has been doing. The only difference, he said, will be in how US Immigration and Customs Enforcement officials respond to calls for pickup. -AP

Changes to the Physical Education and Recreation Center are up and running.

?I love that you can watch TV,? Doris Walker, a senior, said of the updates to the cardio area of the PERC. ?These treadmills have less impact than the old ones so it?s easier to run.?

The updated cardio area, one of six updated units in the PERC, is now located in front of the racquetball courts.

?The decision was made to impact more students by upgrading more than just the track,? Vince Haupert, vice president for advancement, said of the multiple new improvements to the PERC. ?There isn?t one piece of equipment in the facility that isn?t brand new.?

Walker said she appreciates the changes that were made, with only one minor issue.

?I like the open running space,? Walker said of the new location. ?There?s more air flow, but I wonder if some people might feel uncomfortable running where everyone can see you.?

Russ Lawson, coordinator of recreational development, said that the move added a couple of additional cardio pieces and upgraded the entire fleet of cardio machines.

?It?s all new, top of the line,? Lawson said. ?I think the students will also like the additional TV counsels and capability to plug their iPods into the machine.?

The exercise room, located to the immediate right when entering the PERC, now has brand new Life Fitness circuit training machines, Troy dumbbells and two TV monitors.

?The last time we had a change with our equipment was twenty years ago,? Lawson said. ?With the new equipment comes more technology, giving the machines a smoother, more free weight feel.?

A new addition to the PERC is a student lounge area. This will be located in front of the cardio area just outside the gymnasium, giving students a place to kill time between practices, games or classes, Lawson said.

Julie Hendryx, director of human resources and auxiliary services, said that the lounge furniture consists of two pub height tables and chairs, along with a counter and stools. The stools have arrived and the tables should come within the next three weeks.

The free weights room has also undergone drastic changes.

?The new equipment in here is Hammer Strength,? Lawson said. ?They?re the provider for the NFL and we felt like if it?s good enough for professional football, it?s good enough for us.?

Lawson said Professor Ruiz was instrumentally in bringing the Hammer Strength equipment here.

The dance room, or mirror room, now has more space to accommodate larger groups.

?Our vision is to open up the space,? Lawson said. ?The only thing that?s really been done so far is we?ve taken stuff out.?

The area was running out of space for classes and other large groups because of the mats on the floor, cardio machines and bikes. These items have been removed and now the space can accommodate a class of 20-30 people, Lawson said.

?We?ve added stability balls, med balls and yoga mats to make it more of our core exercise room,? Lawson said.

The dance room also now has a 55-inch TV, enabling large groups to participate in workout DVDs together.

The track and press box are the last pieces to the current PERC updates.

?We still have to measure and paint the lanes,? Lawson said about the track. ?We are probably looking at two weeks before it?s done.?

Due to the current bug infestation of the soccer field, the press box is on the back burner, Lawson said.

Haupert said these renovations make up the final projects for the Together Campaign.

The total cost of the track and PERC improvements is $950,000. All the money has been raised for this project through donors or revenue from room and board. The cost of the improvements will be completely paid off by 2014 through fulfilled pledges, Haupert said.

Past improvements to the PERC include the addition of brand new bleachers in the main gym.

Looking to the future, Haupert said new plans are already underway to start a new campaign and raise money for pool renovations. This is in the planning stage and no details have been set in stone.

?The general reaction to the new equipment is positive,? Haupert said of his observations of the current renovations. ?Returning students have been very surprised and very excited about the new equipment.?

With a lockout drawing ever closer, the NHL and the players' union are in touch with each other after a day of internal meetings.

But no new negotiating sessions are scheduled for Friday, one day before Commissioner Gary Bettman has said he will lock out the players. This would be the NHL's fourth work stoppage since 1992.

On Thursday night, NHL deputy commissioner Bill Daly spoke to special counsel Steve Fehr, the brother of union executive director Donald Fehr. They did not, however, discuss a possible return to the bargaining table.

The contract expires at midnight EDT on Saturday. Bettman has said the season won't start without a new deal. Training camps are to open Sept. 21, and the season is to begin Oct. 11.

"We have been clear that the collective bargaining agreement, upon its expiration, needs to have a successful agreement for us to move forward," Bettman said Thursday. "The league is not in a position, not willing to move forward with another season under the status quo."

The players turned out in force just a few blocks away at another midtown Manhattan hotel. Solidarity was evident, but optimism wasn't. The last labor stoppage caused the cancellation of the entire 2004-05 season, a lockout that ended only when players accepted a salary cap and a 24 percent rollback of salaries.

"Right now it's not looking great," said Pittsburgh Penguins star Sidney Crosby, who was just 17 when the last lockout ended, "but things can change pretty quickly."

Following lockouts last year by basketball and football owners, Bettman says hockey management is determined to come away with economic gains, even if it forces another work stoppage.

"Two other leagues ? the NBA and the NFL ? their players have recognized that in these economic times there is a need to retrench," Bettman said after a two-hour owners' meeting Thursday.

Damage from another lockout will occur almost immediately, and there is no telling how jilted fans and sponsors will react to another shutdown, especially if it lasts well into the fall and winter.

"One of the questions that needs to be asked is, if indeed they lock out, if indeed they do do that, (whether) that is reasonably calculated to make a deal more likely or less likely?" Donald Fehr said Thursday. "I think you can figure out the answer."

Management's latest offer has a short shelf life. Once the lockout begins, Bettman says the economic damage would cause owners to offer players a less beneficial deal.

Players currently receive 57 percent of hockey-related revenue, and the owners want to bring that number down as far as perhaps 47 percent ? which is an increase from their original offer of 43 percent. The union offered a deal based on actual dollars, seeking a guarantee of the $1.8 billion players received last season.

"The fact is, we believe that 57 percent of HRR is too much," Bettman said. "Even a brief lockout will cost more in terms of lost salary and wages than what we're proposing to do to make a deal that we think we need to make."

The current contract was agreed to in 2005, and Bob Goodenow resigned as union head two weeks later. After stints by Ted Saskin and Paul Kelly, the union in 2010 turned to Fehr, who led baseball players through three work stoppages in the 1980s and '90s.

Buffalo Sabres goalie Ryan Miller said Fehr is doing a far better job communicating with members than leadership did in the last lockout. The 30 league owners are prohibited by NHL bylaws from publicly commenting about negotiations.

"I doubt that all the owners are as well informed as all the players," Miller said. "I don't know if that's going to get me in trouble or not. I just feel like it's kind of whatever they are told by Gary. I guess it's a little bit like politics. ... You have this whole thing where I'm sure they feel like a lot of what we're saying is spin."

Players struck in April 1992, causing 30 games to be postponed.

This would be the third lockout under Bettman. The 1994-95 lockout ended after 103 days and the cancellation of 468 games. The most recent lockout was finally settled in July 2005 ? 301 days into the work stoppage and a month after the league would usually have awarded the Stanley Cup.

"You get a real sense of the unity and the commitment and the participation and the understanding and the knowledge that these players have," Fehr said. "It's very gratifying.

"The players very much want to reach an agreement, provided that it is one which is fair and which is equitable and treats them appropriately."

Bettman said the union has controlled the scheduling of the meetings and suggested players had reasons for wanting to delay negotiations. The league tried to start talks last summer, at last winter's All-Star game, during the playoffs last spring and again at the Stanley Cup finals.

"It looks like there was no urgency on the part of the players' association to engage or get anything done," Bettman said. "It's happened over the summer. I can't and won't speculate as to why that would be their intention, but it is what it is. If you look at the record and you look at it in hindsight, I think it is crystal clear."

Annual industry revenue has grown from $2.1 billion to $3.3 billion under the expiring deal. Owners asked players to cut their share of hockey related revenue during a six-year proposal. Players are concerned management hasn't addressed the league's problems by re-examining the teams' revenue-sharing formula.

The owners' latest offer raised the percentage of hockey-related revenue given to players from the previous proposal of 46 percent. Initially, the NHL sought to drop the number from the current 57 percent to 43 percent.

Having made several big concessions to make a deal in 2005, the union doesn't think it should have to make more this time after record financial growth.

"We believe that what we proposed is in the right direction," Crosby said Thursday. "If you look at both, they're definitely different, but if you have a nonbiased opinion, you look at the facts. I think our mindset and the direction we're going is one that seems like it's a little bit more fair for both sides."

Bettman cited the on-ice success for teams, noting there have been seven different champions over the course of this contract and all clubs but the Toronto Maple Leafs qualified for the playoffs at least once. The average player salary also jumped from $1.45 million to $2.55 million.

"We've had seven years of incredible competitive balance," Bettman said. "The game on the ice has never been better. That is a function of this system. The system as originally negotiated needs some adjustments. It turned out to be too rich a deal for the first seven years. We lived with it, but I'm not going to apologize for saying we need to adjust it.

"The thought was somehow they got slammed in the negotiations last time. They didn't. We made at the time what we thought was a fair deal. It actually turned out to be more fair than it should have been."

A mistake at the UK Apple website?caused some confusion Friday when it claimed that the iPhone 5 would come with a free Lightning-to-30-pin adapter. The?website?has been updated, but not before making a few users rather angry.

Apple's new iPhone 5 has a brand new type of cable that, replacing the familiar wide connector found on so many devices worldwide. While the change was inevitable, many are complaining that it makes thousands of accessories and cables obsolete ? and meanwhile, Apple charges a rather high $29 for the simple adapter.

UK customers pre-ordering their iPhone 5 received a pleasant surprise this morning, however, as the "accessories" portion of the ordering process promised a free one:

Some?American customers were disappointed to find that it wasn't offered in the U.S., and thought they were getting an unfair deal. But when a customer asked Apple, the company informed everyone that the whole thing was an error, and it the site?was corrected shortly after.

Those who ordered pre-ordered the phone?who had seen the initial Web offer?were left wondering whether Apple would honor the product description given on the site.?After all, they might have chosen not to buy an adapter because the description said it came with one.

Historically, some?companies have opted to honor the mistaken terms, even when doing so is very costly; for instance, Amazon once accidentally offered a free $350 camera when you bought a $40 bag, rather than vice versa, and honored many of?the orders that came in before it was corrected.

In Apple's?case, it may be several thousand people who would need to receive the $30 adapter ? perhaps not too much to pay for a bit of good PR.

(AP) ? More than 350,000 public school students spent a fifth day out of class Friday as bargaining to end the city's teachers strike dragged on ahead of a meeting of union delegates whose approval is required to seal any deal.

Rank-and-file teachers returned to the streets for morning rallies to press the union's demands, which include a plan for laid-off instructors to get first dibs on job openings and for a teacher-evaluation system that does not rely heavily on student test scores.

Contract talks pushed on for more than 15 hours Thursday with little word of progress until negotiators called it quits early Friday. School Board President David Vitale said the two sides had worked past the evaluations issue and had begun crunching numbers on financial matters. He did not elaborate.

Chicago Teachers Union President Karen Lewis said negotiators had many "productive" conversations, but she declined to describe the talks in detail. She and Vitale said they hope students can be back in class Monday.

"It was a long day," Lewis said. "There were some creative ideas passed around, but we still do not have an agreement."

As negotiators went back to the bargaining table Friday, the school district's chief education officer, Barbara Byrd-Bennett, agreed that the sides were close. She thought they could come to an agreement before the end of the day.

The union called a meeting for Friday afternoon of some 700 delegates who would be required to approve any contract settlement with a majority vote. The meeting could be used to present an agreement or merely to update union members on negotiations.

The strike by more than 25,000 teachers in the nation's third-largest school district has idled many children and teenagers, leaving some unsupervised in gang-dominated neighborhoods. It also has been a potent display of union power at a time when organized labor has lost ground around the nation.

School district officials said the main sticking points the evaluation system and the union's demands that laid-off teachers get top consideration for rehiring. The district worries that could result in principals being forced to hire unsuitable teachers.

The union says using student test scores to evaluate teacher performance is unfair, arguing that poor test results can be the result of poverty, hunger and other conditions beyond their control. Under an older proposal by the district, the union estimated that 6,000 teachers could lose their jobs within two years.

An offer made late Wednesday included provisions that would have protected tenured teachers from dismissal in the first year of the evaluations. It also altered categories that teachers can be rated on and added an appeals process.

The other outstanding issue was whether laid-off teachers should have first shot at open jobs. School officials plan to close 100 schools "as soon as the ink is dry" on a new contract, unfairly displacing teachers, many African-American, who work in struggling schools that often don't have adequate resources, Lewis has said.

The union is trying to win assurances that laid-off but qualified teachers get dibs on jobs anywhere in the district. But Illinois law gives individual principals in Chicago the right to hire the teachers they want, and Mayor Rahm Emanuel argues it's unfair to hold principals accountable for their schools' performance if they can't pick their own teams.

The district has offered a compromise. If schools close, teachers would have the first right to jobs matching their qualifications at schools that absorb the children from the closed school. The proposal also includes provisions for teachers who aren't hired, including severance.

It wasn't clear if the union had accepted the proposal, but Lewis said it "did not intend to sign an agreement until these matters are addressed."

Readers of the Sun-Times opened the paper Friday to a full-page letter to Emanuel written by the Boston Teachers Union.

In the letter, the union reminded readers that some of the things Chicago teachers are fighting have long been available to Boston teachers, including the right to let teachers with seniority move into jobs in other schools if their schools close down.

Perhaps more significantly, the union took Emanuel to task for the contentiousness of the negotiations, putting the blame on the mayor's shoulders.

"Perhaps you can learn from us ? and begin to treat your own teaching force with the same respect," the union wrote.

Meanwhile, Chicago teachers said they were planning a "Wisconsin-style" rally for Saturday, regardless of whether there is a deal on the contract.

The union has won widespread support from other teachers unions around the country, and a couple of hundred Wisconsin teachers planned to come to Chicago to join the event.

"It's really sort of a spontaneous kind of organizing," said Bob Peterson, president of the Milwaukee Teachers' Education Association, which unsuccessfully sought the recall of Gov. Scott Walker.

The walkout is the first Chicago teachers strike in 25 years. A 1987 walkout lasted 19 days.

Emanuel has called the strike unnecessary and repeatedly urged the union to continue negotiations once students are back in class.

Former Davenport Mayor Gets Probation for Theft

DAVENPORT, Iowa (AP) ? Former Davenport Mayor Pat Gibbs has been sentenced to three years of probation for stealing thousands of dollars from a pawn shop where he worked.

The Quad City Times reports that the 53-year-old Gibbs received a deferred sentence Thursday in Scott County District Court. If he violates probation, the deferred judgment will be revoked and he could face up to five years in prison. But if he successfully completes probation, the case will be stricken from his record.

Gibbs pleaded guilty last month to theft for stealing almost $10,000 from his employer, Del-Rich pawnshop, in Davenport.

Gibbs was mayor of Davenport for six years, from 1992 to 1998, and served as a Scott County supervisor from 1998 to 2002.

University of Rochester Medical Center scientists discovered new genetic evidence linking cholesterol and cancer, raising the possibility that cholesterol medications could be useful in the future for cancer prevention or to augment existing cancer treatment.

The data, published in the online journal Cell Reports, support several recent population-based studies that suggest individuals who take cholesterol-lowering drugs may have a reduced risk of cancer, and, conversely that individuals with the highest levels of cholesterol seem to have an elevated risk of cancer.

The cancer-cholesterol question has been debated since the early 20th century, and along with it doctors and scientists have observed various trends and associations. However, until now genetic evidence directly linking cholesterol and malignancy has been lacking, said senior author Hartmut (Hucky) Land, Ph.D., Robert and Dorothy Markin Professor and chair, Department of Biomedical Genetics, and director of research and co-director of the James P. Wilmot Cancer Center at URMC.

"Scientifically it is very satisfying to have data that support longstanding ideas about cholesterol in the context of cancer," Land said. "Our paper provides a rationale for cholesterol targeting as a potentially fruitful approach to cancer intervention or prevention strategies."

Cholesterol is a fat-like substance supplied in foods and made in cells throughout the body. Too much cholesterol is bad for the heart and vascular system. It is typically measured as serum cholesterol by routine blood tests.

Unlike serum cholesterol that is bound to proteins, however, cholesterol also hides inside cells. While locked inside cell membranes before it is eventually exported, cholesterol has an impact on cell growth and survival. A gene, known as ABCA1, is at the crossroads of the process that shuttles intracellular cholesterol outbound.

Several years ago while conducting unrelated experiments that were published in the journal Nature, Land and colleagues first noticed the importance of ABCA1. At that time, they identified a network of approximately 100 so-called "cooperation response genes" that mediate the action of cancer genes. ABCA1 was found among these genes and is frequently turned off in presence of other mutant cancer genes.

In the latest investigation, Land and co-author Bradley Smith, Ph.D., a post-doctoral fellow in the Land lab, wanted to further understand the role of ABCA1 and cholesterol in cancer. They found that defective cholesterol exportation appears to be a key component in a variety of cancers.

The proper function of ABCA1, in fact, is critical for sensing of cell stress. If ABCA1 function is lost in cancer cells, cholesterol is allowed to build up in the cells' mitochondria, or energy centers, making their membranes more rigid. This in turn inhibits the function of cell-death triggers that normally become activated in response to cell stresses, as for example cancer gene activation. Therefore, when functioning properly ABCA1 has anti-cancer activity in the sense that by keeping mitochondrial cholesterol low it protects the functioning of cellular stress response systems and acts as a barrier to tumor formation and progression.

Smith and Land also demonstrated that some of the relatively rare ABCA1 mutations found in human colon cancers by other investigators disabled the gene's ability to export cholesterol. And by re-establishing the cholesterol export function in human colon cancer cells, they inhibited the cells' ability to grow as cancers when grafted onto mice.

The URMC study, therefore, is the first to directly show how ABCA1 loss-of-function and cholesterol may play a role in cancer.

Millions of Americans take cholesterol-lowering drugs or statins, as prescribed by physicians. The drugs work by blocking the action of key enzymes in the liver, which synthesizes cholesterol. Clinical trials also are evaluating statins as a tool against cancer, and some previous studies suggest that when used in combination with chemotherapy, statins might make chemotherapy more effective by sensitizing certain cancer cells to chemotherapy-induced cell death.

Land, however, urges caution and further study. Doctors do not know the appropriate statin dose for cancer prevention or treatment of cancer-related conditions. Side effects cannot be ignored either, and little research has distinguished between the responses among people who take statins.

"The link between cholesterol and cancer is clear," Land said, "but it's premature to say that statins are the answer."
